Our booking conditions are as follows: I acknowledge Active
Downunder does not own or operate any of the suppliers of services or
accommodations for my trip. As a result, it is not responsible for any
negligent or willful act or failure to act of any such supplier or of
any other third party over whom Active Downunder has no control.

Deposit and Balance of Payments: To begin the
reservation process: A deposit of US$300 per person is required for
all bookings. The balance of payment is required 60 days prior to
departure date or, if booking within this period, full payment is due
immediately upon booking confirmation. If your payment is not received
on time, your reservation will be cancelled. All deposits are
non-refundable.

Cancellation Cancellation penalties may vary depending on the products booked. Customer cancellation before the full payment due date will incur loss of the non-refundable deposit as specified above. Customer cancellation on or after the full payment due date, but more than 7 days prior to departure, will incur a penalty equal to 50% of the total booking cost. Active Downunder will make no refunds for Customer Cancellations made less than 8 days before departure or subsequent to travel commencement. Other cancellation fees or refunds for Customer cancellation are at the discretion of the hotels, tour operators, rental car agencies and other Service Providers with which Customer has reserved Travel Related Services. Travel Insurance purchases are non-refundable. Cancellation Fees (Land): Cancellation fees will be levied relative to the amount of notice given, as follows (minimum US$300 per person). When you cancel a trip, we must ask you to please notify us in writing. Exceptions to this policy cannot be made for any reason. If the seller cancels transportation or other services, all sums to the seller of travel for services not performed in accordance with the contract between the seller of travel and the purchaser will be refunded. This will be within thirty days of receiving the funds from the vendor with whom the services were arranged. However, if the funds were not sent to the vendor, the funds shall be returned within fourteen days after cancellation. The responsibility will be by the seller of travel to apply the money to another travel product and/or date.

Full Payment Is due 60 days prior to departure date
or immediately if within that period. Some tours, particularly
multi-day guided walks will require earlier payment. Customer will be
notified at time of booking if earlier payment is required.

Travel Insurance We STRONGLY RECOMMEND purchasing
travel insurance at time of booking. Travel Insurance can be purchased
to cover all penalties in the event you need to cancel or change travel

policies. Please ask us for a quote at time of booking. Charges will
appear on your credit card by ACCESS AMERICA. Travel Insurance is
non-refundable.

Payments We accept Visa, Mastercard, Discover and
American Express. Checks should be made payable to ACTIVE DOWNUNDER,
1220 Rosecrans Street, # 911, San Diego, CA 92106.

Airfares (**Important**) Airfares and taxes are
subject to change and not guaranteed until paid in full. Airfares are
subject to special fare conditions, subject to currency fluctuations
and subject to change without notice. Penalties may apply for
cancellation or amendments. Airpasses & Domestic Tickets in
Australia, New Zealand and the South Pacific are subject to currency
fluctuations and the fare quoted is not guaranteed until paid for in
full. This applies to all clients purchasing airfares as part of a
package or customized itinerary. CURRENCY FLUCTUATIONS, AIRFARE AND
TAX INCREASES DO HAPPEN AND IT IS RECOMMENDED YOU PURCHASE YOUR AIRLINE
TICKETS TO AVOID THESE PRICE FLUCTUATIONS.

Frequent Flyer Miles We are happy to add your
frequent flyer number to your booking. If you are accruing frequent
flyer miles on any of the airlines used on your Active Downunder
itinerary, please verify at check-in that your mileage plans are in
place. Also, be sure to keep all of your passenger receipts (stapled
to back of tickets) for proof of travel should mileage not appear on
future Statement. A charge will be assessed if Active Downunder is
asked to produce ticket copies.

Seating Requests We are pleased to make a seating
request (ie: aisle, window) for your travel. Please note, seating
requests are 'requests' only. While we may be able to provide you a
'seat number', this seat is not guaranteed until check-in. Air New
Zealand & Qantas Airlines reserve the right to change seating
requests. Active Downunder is not responsible for the seat you are
assigned.

Document All documents are sent by Fed-Ex 3 Day Service. A Fee of $15.00 will automatically be charged for this service.

Nominated Industry Partners Active Downunder works
in conjunction with travel wholesaler, Down Under Answers, Air New
Zealand, Qantas, Australia 2 See and Access America. On some occasions, any of these companies
may be used to book specific products on behalf of either; you (the
client) and Active Downunder. Therefore, some credit card charges may
appear from any of the above companies.

Refunds (**Important**) 1. No refunds will be given for unused portions of air tickets, ferry, train or car rentals. 2. Refunds will be granted for unused accommodation/service vouchers that could not be used due to unforeseen circumstances. 3.
No refunds will given for unused services (accommodation, sightseeing
& tours etc). confirmed by ACTIVE DOWNUNDER or it's NOMINATED
AGENTS/WHOLESALERS once you have departed the US. Once you have left
the US you cannot simply change your mind and expect a refund.
Communication costs have been incurred and payments have been made to
suppliers to secure the service you have been confirmed on and a refund
will not be given. Changing your mind does not represent unforeseen
circumstances. If a refund is authorized (by Manager approval) then a
cancellation fee of 20% WILL be charged. 4. Any cancellation or
amendment to arrangements confirmed for you must be made with the prior
written approval of ACTIVE DOWNUNDER or it's nominated Industry
Parnters in the country the booking was made from to ensure a refund is
payable. Product Suppliers are unable to authorize refunds under any
circumstances. We strongly recommend you purchase Travel Insurance to
cover you for any such eventuality. Cancellation charges cannot be
waived where Travel Insurance would have covered your situation. All
refunds must be requested within thirty days of the conclusion of your
vacation.

California Seller of Travel
ACTIVE DOWNUNDER is a registered California Seller of Travel, Reg No. 2060868-40
Travel Consumer Restitution Corporation (TCRC) ACTIVE DOWNUNDER is a participant in the Travel Consumer Restitution Corporation (TCRC). You, the passenger, may request reimbursement from TCRC if you are owed a refund of more than $50 for transportation or travel services which was not refunded in a timely matter by a seller of travel who was registered and participating in the TCRC at the time of sale. The maximum amount which may be paid by the TCRC to any one passenger is the total amount paid on behalf of the passenger to the seller of travel, not to exceed $15,000. A claim must be submitted to the TCRC within six months after the scheduled completion date of the travel. A claim must include sufficient information and documentation to prove your claim and a $35 processing fee. You must agree to waive your right to other civil remedies against a registered participating seller of travel for matters arising out of a sale for which you file a claim with the TCRC, if you were located in California at the time of the sale. Customers located outside of California. This transaction is not covered by the California Travel Consumer Restitution Corporation. California law requires certain sellers of travel to have a trust account. ACTIVE DOWNUNDER has a trust account held with Wells Fargo.

Prices All prices quoted are expressed in US
dollars and include the Australia GST. ACTIVE DOWNUNDER or it's nominated industry partners reserve
the right to amend pricing without notice and are subject to change
until final payment is received. All quoted prices will be guaranteed
once final payment has been received. Please be advised, we do not
itemize or breakdown pricing for any of our packages or custom designed
itineraries. Please note: currency fluctuations do occur and price
adjustments are made from time to time to accommodate the fluctuations.

Amendments Once an itinerary has been priced and
agreed upon, your reservations will be confirmed. A change fee of $35
per change will be charged if any changes are made after confirmation
and before issuance of documents. Changes made between 15-30 days prior
to departure, or after documents are issued, will be charged $60 per
change handling fee. A fee of $85 per change will be assessed for
changes made within 14 days prior to departure. If such changes
necessitate cancellation of confirmed air or ground arrangements,
unrecoverable costs will be added to the change fee.

Conditions of Carriage ACTIVE DOWNUNDER or it's
NOMINATED INDUSTRY PARTNERS (herein called the company) acts only as an
Agent for the hotels, airlines, tour operators, rental car companies or
other services (herein called the contractor). All vouchers, receipts,
contracts and tickets issued by the company are issued subject to any
and all tariffs, terms and services whatsoever are provided by the
Contractors, and by acceptance of such documents, the traveler agrees
to the foregoing and also agrees that neither the COMPANY nor any
subsidiary or affiliate company shall be or become liable or
responsible for any loss, injury or damage to person, property or
otherwise in connection with any accommodation, transportation or other
service or resulting directly or indirectly from beyond the Company’s
control. The Company does not accept liability for failure on the part
of transportation companies whose responsibility is confined to their
own operation. The Company, its Associates or Nominated Industry
Partners and Employees are not liable for: a) Any event beyond their
control, including (but not limited to) war, disturbance, fire, flood,
unusually severe weather, act of God, act of Government of other
Authorities, accident or failure of equipment or industrial action
(whether or not including the Company’s or Contractors employees nor b)
Any act of omission whatsoever (whether within or outside their
control) in relation to any booking, contract travel, accommodation,
excursion or other vacation services (including carriage or baggage)
which results in any direct, indirect or consequential loss, damage,
death, injury, delay, liability, additional expenses or inconvenience. c)
ACTIVE DOWNUNDER does not own or operate any tour product or service.
ACTIVE DOWNUNDER or it's NOMINATED INDUSTRY PARTNERS is a tour and
travel wholesaler who arranges the provision of products &
services. ACTIVE DOWNUNDER or it's NOMINATED INDUSTRY PARTNERS does not
take responsibility for the omission or failure of individual
properties, plant or services advertised.
